1. Binding Terms of Use
1.1 The following terms of service ("Terms") set forth the rules that govern your use of the website daytrip.co.nz and any related booking services operated by daytrip. ("daytrip", "we", "us", or "our"). Please read these Terms carefully. By accessing or using our services, you agree that you have read, understand, and agree to be bound by these Terms. These Terms are governed by and construed in accordance with the laws of New Zealand, and any disputes shall be subject to the exclusive jurisdiction of the courts of New Zealand.
1.2 daytrip reserves the right to modify these Terms periodically. Any changes will become effective upon posting to our website along with the date last updated. Continued use of our services after changes constitutes acceptance of the modified Terms.

3. Nature of Services
3.1 daytrip operates as a booking platform that connects customers ("Users") with professional tour guides and transportation service providers ("Guides") for private tour services ("Tour Services") throughout New Zealand.
3.2 Important: daytrip does not provide transportation services directly. We facilitate bookings between Users and independent Guides. daytrip is not a common carrier, motor carrier, or transport operator. Guides are independent contractors and are not employees, agents, or representatives of daytrip.
4. Booking Process
4.1 To book Tour Services through daytrip:
- Select your tour, destination, date, time, and number of guests
- Provide required contact information including name, email, and phone number
- Submit your booking request or quote request
- Upon confirmation, we will arrange a Guide and provide you with booking details
- Payment terms will be communicated at time of booking confirmation
4.2 By submitting a booking request, you represent that you have the authority to book on behalf of all guests and that all guests agree to these Terms.
5. Pricing and Payment
5.1 Prices displayed on our platform are in New Zealand Dollars (NZD) and are subject to the following:
- Prices are per person and vary based on number of guests
- Additional charges may apply for locations outside standard tour areas
- Prices are inclusive of GST where applicable
- Payment methods and terms will be confirmed at time of booking
5.2 All prices are indicative quotes. Final pricing will be confirmed in your booking confirmation.
6. Cancellations and Modifications
6.1 All cancellations must be made by contacting us at book@daytrip.co.nz. Cancellation fees apply as follows:
- More than 4 days (96 hours) before service: Full refund
- Less than 96 hours but more than 48 hours before service: 25% cancellation fee applies (75% refund)
- Less than 48 hours before service: 100% cancellation fee applies (no refund)
- Modifications to bookings are subject to availability and may incur additional charges
6.2 Cancellation fees are calculated based on the scheduled start time of your tour.
6.3 No-Show Policy
6.3.1 For flight or conveyance arrivals, the guide will meet you at the actual arrival time. For all other pickups, guides will arrive at the agreed booking time. The following waiting times apply:
- International flight arrivals: Guide will wait a maximum of 120 minutes from actual arrival time
- All other locations: Guide will wait a maximum of 30 minutes from the booked pickup time
- Domestic flight arrivals: Guide will wait a maximum of 30 minutes from actual arrival time
6.3.2 If you fail to meet the guide within the specified waiting period, this will be considered a no-show and 100% of the booking amount will be charged with no refund.
6.3.3 If you require additional waiting time beyond these limits, additional fees will apply and must be paid to the guide upon demand. Please contact us in advance if you anticipate delays.
7. Baggage Allowance
7.1 The standard baggage allocation per person is: 1 suitcase and 1 carry-on item.
7.2 Additional items such as child restraints, child strollers, wheelchairs, and other bulky items are considered additional baggage and may require space equivalent to one passenger.
7.3 For tours with additional items beyond the standard allowance, guests may be required to pay an additional person fee per tour. Please inform us of any extra baggage or special items when booking to ensure appropriate vehicle arrangements.
7.4 Child Restraints
7.4.1 Under New Zealand law, specifically Factsheet 7 of the Restraints regulations, all passenger service vehicles are exempt from the provision of child restraints. Additionally, there are legal implications for fitting your own restraint to our vehicles.
7.4.2 If you are traveling with children, we are happy to examine your requirements and advise on what can be done to accommodate your needs. If child restraints are provided by daytrip, additional fees will apply.
7.5 Damage to Suitcases and Bags
7.5.1 Suitcases, bags, and other similar items are considered packaging for the purposes of this service. Accordingly, no claim can be made or received for any damage or mishandling of these items during the tour service. Guests are advised to ensure their belongings are adequately protected and insured prior to travel.
8. User Responsibilities
8.1 As a User, you agree to:
- Provide accurate and complete information when booking
- Be present at the agreed pickup location at the scheduled time
- Treat Guides with respect and courtesy
- Not engage in any illegal activities during tours
- Ensure all guests, including children, are properly secured
- Not damage the vehicle or property of the Guide
- Comply with all New Zealand laws and regulations
8.2 Vehicle Conduct Policy
8.2.1 To maintain the quality and comfort of our premium vehicles, the following policies apply:
- The consumption of food or drink is not permitted in the vehicle unless the guide agrees
- Alcohol, drugs, and cigarettes are NEVER permitted in the vehicle under any circumstances
- Violation of these policies may result in immediate termination of service without refund
9. Liability and Disclaimers
9.1 Service Provided by Third Parties: Tour Services are provided by independent Guides. daytrip is not liable for any acts, omissions, or conduct of Guides or for any injuries, damages, or losses arising from the Tour Services.
9.2 No Warranties: Our booking services are provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service.
9.3 Limitation of Liability: To the maximum extent permitted by New Zealand law, daytrip's total liability for any claims arising from these Terms or use of our services shall not exceed the amount paid by you for the relevant booking.
9.4 Nothing in these Terms excludes or limits liability that cannot be excluded or limited under New Zealand law, including liability for death or personal injury caused by negligence.
10. Insurance
10.1 All Guides providing Tour Services through daytrip are required to maintain appropriate insurance coverage as required by New Zealand law. However, daytrip does not guarantee or verify such coverage and is not responsible for any insurance claims.
11. Privacy and Data Protection
11.1 We collect and process personal information in accordance with New Zealand privacy laws. By using our services, you consent to:
- Collection of your contact details and booking information
- Sharing necessary information with Guides to facilitate your booking
- Use of your information to communicate about your booking and our services
- Storage of your information for record-keeping and service improvement
11.2 We will not sell or share your personal information with third parties for marketing purposes without your consent.
12. Intellectual Property
12.1 All content on the daytrip platform, including text, graphics, logos, and software, is the property of daytrip or its licensors and is protected by New Zealand and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
13. Termination
13.1 daytrip reserves the right to refuse service, cancel bookings, or terminate access to our platform for any user who violates these Terms, engages in fraudulent activity, or for any other reason at our sole discretion.
14. Force Majeure
14.1 Neither daytrip nor Guides shall be liable for any failure to perform obligations due to circumstances beyond reasonable control, including but not limited to natural disasters, severe weather, strikes, government actions, or other force majeure events.
15. Dispute Resolution
15.1 These Terms are governed by the laws of New Zealand. Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of New Zealand.

16. Consumer Rights
16.1 Nothing in these Terms affects your rights under the Consumer Guarantees Act 1993 or other applicable New Zealand consumer protection legislation.
17. Severability
17.1 If any provision of these Terms is found to be invalid or unenforceable under New Zealand law, the remaining provisions shall continue in full force and effect.
18. Entire Agreement
18.1 These Terms constitute the entire agreement between you and daytrip regarding use of our services and supersede all prior agreements and understandings.
